Terms and conditions

These terms are an agreement between you and Spearhead Media LLC ("Spearhead Media", "we", "us"), of San Diego, California. They cover the production services we provide, the digital products sold in the Spearhead Creators Store at spearheadcreatorsstore.com, and your use of spearheadmedia.com. By booking a shoot, placing an order or using the site, you agree to them.
Other Spearhead services have their own terms that apply alongside these: ShootDeck (book.spearheadmedia.com), where real estate shoots are booked online, Spearhead Stock (spearheadstock.com) for stock footage licenses, and the ShootLight app, which Apple sells under its App Store terms. If a signed quote or statement of work for a project says something different from these terms, the quote or statement of work wins for that project.
1. Production services
This section covers photography, video, aerial and related work we are hired to create ("the Project"), and what we deliver ("the Deliverables").
Scope and your license
- What we shoot and deliver is set out in the package you book or the quote you accept.
- Once the Project is paid in full, you may use the Deliverables for the purpose they were made for: for real estate, marketing the property on listing sites, social media, email, print and in video tours; for other work, the uses agreed in the quote. You may not resell the Deliverables or license them to third parties unless the quote says so.
- Raw footage and photos, and the copyright in everything we create, remain the property of Spearhead Media LLC.
- We may use the Deliverables to promote our business, including in portfolios, exhibitions, on our websites and on our social media accounts, and we may produce a "Director's Cut" of the Deliverables, with all creative decisions at our discretion. Tell us before the shoot if a project is confidential and we will agree what we can show.
Revisions
- Standard and Premium video packages include one Minor Revision of the full-length video. Signature video packages include two. A Minor Revision is one hour of editing time.
- After the included revisions, further changes are billed at $200 per hour.
- If you ask us to return to a property to shoot more for any reason, the return visit is billed at $200 per hour on site, with a two-hour minimum.
Turnaround and file retention
- Standard, Premium and Signature videos are delivered within 7 days, once we have everything we need from you (headshots, logos, contact details and similar).
- Standard Photos and Aerial Photos are delivered within 2 days.
- Please download and keep your Deliverables. We delete all project files within 3 months of the shoot date.
Cancellation
Cancellation fees are a share of the total amount due for the booking, measured against the original booking date:
- Cancelling any time before the windows below: 20%.
- Within 48 hours of the shoot: 25%.
- Within 24 hours of the shoot: 30%.
- On the day of the shoot, or with our crew on site: 50%.
- If a booking is made with the intent of cancelling it, no more than 50% of the total will be refunded.
Rescheduling
- Rescheduling for weather on the shoot day: no charge (the shoot must be rescheduled).
- Rescheduling within 24 hours of the shoot, not for weather: $150.
- Rescheduling on the day: 20% of the total due or $250, whichever is greater.
- Rescheduling with our crew on site: 25% of the total due or $350, whichever is greater.
- A new date must be set within one week, or the change is treated as a cancellation.
Delays on site
If the property is not ready when we arrive (workers on site, rooms not staged, access not arranged), delays are added to the total due for that property:
- 30 minutes in total: 10%.
- 45 minutes in total: 20%.
- One hour or more: treated as an on-site reschedule, at 20% of the total due or $250, whichever is greater.
Invoices and credits
- Invoices are due on receipt unless your quote says otherwise. Invoices 45 days late incur a 20% late fee, 90 days late 30%, and 120 days late 40%.
- Remaining funds or credits from a previous shoot must be used within 6 months of the original booking date.
2. Creators Store digital products
The Creators Store sells digital products: LUT packs, Lightroom and Camera Raw presets and brushes, bundles, and the Spearhead Color System plugin for Final Cut Pro ("Products"). Products are delivered as downloads, by a link on the order page and by email, as soon as payment clears.
Your license
When you buy a Product, you get a personal, non-exclusive, non-transferable license to install it on computers you use and to use it in as many of your own projects as you like, personal or paid client work, with no royalties. The finished photos and videos you make with it are yours.
You may not:
- resell, share, give away, sublicense or redistribute the Product files, or the files with small changes, whether on their own or as part of another pack, template, app or product;
- upload them where others can download them, or share one purchase across a team (write to us for team or studio licenses);
- remove copyright notices, or try to get around license checks in the plugin.
The Products, including the looks, presets and plugin code, remain the property of Spearhead Media LLC. If you break these license terms, the license ends and you must delete the files.
Updates and requirements
Updates to a Product you own are free. Each Product page lists what it needs to run (for example, the Color System needs Final Cut Pro and a supported version of macOS). Please check it before you buy.
The Spearhead Color System pre-order
- The Color System is on pre-order at a pre-sale price. It is expected to ship on 1 November 2026 and is guaranteed to ship by 1 December 2026 (the guaranteed ship date). When it ships you get a download link by email, and it appears on your order page.
- The Spearhead Color System includes the Spearhead Ultimate Bundle, delivered as soon as you pay, on pre-orders and after release alike.
- If the plugin has not shipped within 30 days after the guaranteed ship date (that is, by 31 December 2026), you can ask for a full refund of the pre-order, and you may keep the Ultimate Bundle.
Sales are final
Products are downloadable the moment you pay, so all sales of digital products are final and are not refunded. If a Product has a problem (a file that is faulty or does not work as described), email support@spearheadmedia.com with your order number and we will fix it: a corrected file, or help getting it working. This does not affect any rights you have under the law where you live.
3. Payments
- Creators Store payments are taken by Stripe, which handles your card details; we never see or store them. Prices are in US dollars. Any sales tax that applies is shown at checkout.
- Shoots booked through ShootDeck are paid as set out in that booking flow. Other production work is paid as set out in your quote or invoice, under the late fees in section 1.
- If a payment is reversed or disputed, the license for the Products in that order is suspended until it is settled.
4. Using this site
- The films, photos, text and design on spearheadmedia.com and spearheadcreatorsstore.com belong to Spearhead Media LLC or to our clients and are protected by copyright. You may view and share links to them, but you may not download, copy or reuse them without our written permission.
- Please do not misuse the site: no scraping, no automated submissions, no attempts to break its security, and nothing unlawful sent through our forms.
- When you send us a brief through the quote form, what you tell us is used to reply and to prepare your quote.
5. Privacy and tracking
How we collect and use personal information, including the cookies and the Meta and Google measurement you can switch on or off, is set out in our privacy policy. You can change those choices at any time from Your privacy choices. We do not sell personal information.
6. Warranties and liability
We do our work with professional care. Beyond that, the site and the Products are provided as they are: we do not promise that a Product suits every project or every camera, that the site will never be interrupted, or that it is free of every defect. To the fullest extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose, and we are not liable for lost profits, lost business, or indirect or consequential loss. Nothing in these terms limits liability for fraud, or for anything else that cannot lawfully be limited.
Weather, access and other conditions outside our control can affect a shoot. Where they do, we will reschedule under section 1 rather than deliver work we are not happy with.
7. General
- Changes. We may update these terms. Changes apply from the date at the top of the page and never change the price or the scope of something you have already paid for.
- Governing law. These terms are governed by the laws of the State of California, and the courts of San Diego County have exclusive jurisdiction over any dispute.
- Severability. If any part of these terms is found unenforceable, the rest still applies.
